Is crypto betting legal in Indonesia?

Key Legislation
Law No. 7 of 1974 on Gambling Control
Last Updated: 2016

Crypto betting is strictly illegal in Indonesia. The country's legal framework, primarily the Indonesian Penal Code (KUHP) and Law No. 7 of 1974 on Gambling Control, establishes a comprehensive ban on all forms of gambling. While cryptocurrency trading is permitted as a commodity under the supervision of the Commodity Futures Trading Regulatory Agency (BAPPEBTI), its use as a payment instrument is prohibited.

This prohibition extends to any gambling-related transactions. The Electronic Information and Transactions (ITE) Law (Law No. 11 of 2008, as amended by Law No. 19 of 2016) further solidifies this ban in the digital realm, criminalizing the distribution and facilitation of online gambling content. Article 27(2) of the ITE Law explicitly forbids making gambling content accessible, with violations carrying penalties of up to six years in prison and fines of up to IDR 1 billion, as stipulated in Article 45.

Since there are no specific regulations for crypto gambling, it falls under the general, and stringent, prohibition of all gambling activities.
