The legal status of crypto betting in Germany is complex and falls into a legal gray area. The primary legislation governing gambling, the Interstate Treaty on Gambling 2021 (Glücksspielstaatsvertrag 2021 or GlüStV 2021), does not explicitly regulate cryptocurrencies for gambling purposes. The law requires that all online gambling operators hold a German license and adhere to strict anti-money laundering (AML) and know-your-customer (KYC) regulations.

Since cryptocurrency transactions can offer a degree of anonymity, they conflict with these transparency requirements. The official stance, as noted in legal analyses, is that digital currencies are not permissible for licensed gambling operations. However, this has not stopped offshore crypto casinos from accepting German players.

While the German authorities, led by the Gemeinsame Glücksspielbehörde der Länder (GGL), actively enforce against unlicensed operators, individual players are generally not the primary target of enforcement actions. This creates a situation where players can access these sites, but without the consumer protection afforded by German law.

The use of cryptocurrencies for gambling is therefore not explicitly illegal for the player, but it operates outside the regulated and licensed framework.
